The GreatStar Episode

During the early development of the Myark Multi-Function Tool, Denis was approached by John Hermann, Vice President of Product Development at GreatStar Tools — Asia’s largest manufacturer of hand tools, supplying nearly every major retailer worldwide with over USD 2 billion in annual sales.

At first, the opportunity seemed promising. GreatStar had the size, reach, and resources to take the Myark concept global. But Denis’s instincts — shaped by decades of hands-on experience — told him something wasn’t right. The tone of communication, the probing questions, and the eagerness to access design details without firm commitments all carried the familiar red flags of a potential exploitation.

Trusting his gut, Denis walked away. He had seen too many inventors lose control of their ideas to opportunistic corporations and had long decided that Myark would always remain both the manufacturer and the marketer.

Only months later, Denis’s caution was validated when GreatStar Tools became publicly accused of patent infringement and exploitation of another inventor’s design, confirming his suspicions shown in the link  https://insight.rpxcorp.com/litigation_documents/12552230

That experience reaffirmed the Myark philosophy — to build and grow independently, with integrity and control over every stage of innovation, production, and marketing. It’s a story of resilience, foresight, and an unshakeable commitment to protecting creative work from those who seek to misuse it.

Several email communications between John Hermann and Denis starting at bottom page up are used as a review from a world-leading tool manufacturer and marketer.

"John Hermann states in his first communication with Denis."
"I saw your video of the Myark Wrench and am impressed. I have designed many new hand tools and  have worked with numerous inventors over the years and seen almost every type of tool variation possible. I really like what you have come up with and would like to start a dialogue with you on bringing you tool to market."
Another email John Hermann states:
"I really like what I see of your tool in the video. It presents very well on video and makes me think it would be a good candidate for next years DRTV sales at Lowes. Looking forward to hearing back from you."

Hello Denis,

Just wondering if you had a chance to give Jeff a call? Can you give me your product's patent number in the USA? Do you have one or have you applied for one? If you applied for one, do you  have the filing number. For GreatStar to move forward on a product it needs to at least have a patent application files, as the IP needs to be protected.

Best Regards
John Hermann

Hello Denis,

One of the advantages for an inventor working with a company like GreatStar is that they do not have do put much more time or effort into the development and production of the product. All we would need from you is the Solid Works CAD files, proof of your patent and any recommendations on material and heat treating specifications. We have over 200 engineers and 20 tool and die makers to work on projects. I would assign a team to your product that would perform all of the engineering work, prototyping and marketing research (including packaging design).

By working with GreatStar you would not have to deviate from your normal job routine and should not have to travel. We can send you prototypes and communicate via e-mail to work on any issue we are having with your product. If I felt that it would be useful to have you travel to Hangzhou to be at the factory, it would only be for a week (I sent Jeff Hile to the factory for a week and his invention was much more challenging to manufacture). GreatStar would pay for the airfare, hotel room and food while you where there. There is no monetary risk for you (you are not having to send time or money to develop and bring the product to market) and since we are connected to all of the major retailers in the world, the upside it very big.

I don't know of any companies in our industry that give up front money any more, too many bad experiences with that practice. GreatStar only gets paid when we sell the item to a retailer, so it is not wise to pay up front for an invention that is not sold yet. We incur a lot of expense in marketing the tools to retailers, so we are already spending money to place your product.

I really like your tool, from what I have seen. There are several other similar tools on the market, but your looks like the most useful and durable one. I called one of my inventors, Jeff, and he said that it would be fine to give him a call and talk to him. His phone number is: (724) 816-****. He lives in Pennsylvania and therefore in in the Eastern Time zone.

I look forward to working with you. If you like. I can also send you a copy of our boiler plate Licensing Agreement.

Best Regards
John Hermann

Hi John

You work on royalty, but the royalty's only start when production is sold that could take a year or more or never make market at all.
If I gave you my knowledge and time which there are several style wrenches who would pay that expense such as travelling and accommodation, food
I would have to turn down working on mines in WA Australia that pays for past and future developments in China also on other ideas that would need to go on hold let alone to beable to support my wife and two children in Thailand including my mother in-law who is on her final years of life and needs 24-7 care.

Can GretStar afford my air fares and accommodation plus a salary that can secure the safety of my wife and children during the time of development which can be deducted from royatys later.

Kind Regards
Denis

Hello Denis,

I am glad that you wrote back! I work with many inventors, but there is one that I work with quite often. His name is Jeffery Hile. One of his inventions is going to market at Lowes this 4th quarter as a major DRTV (Direct Response Television) add campaign for Lowes (under the Kobalt brand). The initial order of this item is 1.2 million 2pc sets. I met with Jeff last year at the SEMA auto show in Las Vegas last year and he showed me the item (we call it the Locking Magnum Grip Pliers) and I like the concept (a self locking Vice Grip style pliers). I took it to the Lowes hand tool merchant and they liked the idea. My team in Hangzhou made up prototypes to show to the merchant and I went through the Lowes product selection process. The tool was accepted as one of the 2013 4th quarter DRTV items and Lowes placed the order with us. We are manufacturing the item in our factories in Hangzhou right now and the first 250,000 pieces will ship on the 10th of this month.

This year we are manufacturing all three DRTV items. Two are  inventions from GreatStar (Jeff's Locking Magnum Grip Pliers and one I developed, the HyperKoil Light) and the other one is from another company, but we are manufacturing it. Last year we had two DRTV items with Lowes, the Magnum Grip Pliers (non-locking) and the Double Drive Screwdriver. GreatStar sells to every major customer in the USA and we have a world wide sales presence.

If you like, I will talk to Jeff Hile and ask him if he would mind talking to you so you can get another inventor's take on working with GreatStar. Le me know if this will be helpful to you. We work on a royalty commission basis with inventors. The royalty is a percentage of our sales price to the customer. This percentage runs from between 3% to 7%. On large orders like the Lowes DRTV ones, this adds up to a pretty large sum.

I really like what I see of your tool in the video. It presents very well on video and makes me think it would be a good candidate for next years DRTV sales at Lowes. Looking forward to hearing back from you.

Best Regards
John Hermann
